Can my boss withhold my last check

I quit my job and my boss is saying
he aint giving me my check because
he was keeping it to pay for
damages on a car i towed over a
month ago.

Depending on your state, you may or may not be liable for unintentional or negligent actions that resulted in damages to property. However, in all states you must be paid for any time that you worked. If, in fact, you can be held responsible for the damages that your employer states, it can only get paid by you if you agree to pay or if it successfuly sues you in small claims court. It cannot unilaterally withold your pay.
