Can I take my ex-husband to court to sell our house?

He is living in it but I am on mortgage as primary with him. He is unable to assume the mortgage on his own.

Under the laws of all states in this country if your "ex" wishes to sell the home that you have written about but you do not, he can file a partition action with the court asking that the court order that the home be placed on the market and sold.
