Is there any employment contract or union agreement that affords this employee any protection in this situation? Will their discharge under the circumstances violate company policy? If not, then they are an "at will" employee. This means that as their employer, you can set the conditons of their employment as you see fit. This includes when to teminate this employee and why. In fact, such an employee can be fired for poor job perfomance or for any reason or no reason at all, with or without notice.
