Yes, as far as the law is concerned, but possibly not as far as your employer and the health insurer are concerned.  Usually employers have a written agreement with the insurance company that anyone on the plan stays on the plan until open enrollment time when changes can be made, including dropping the coverage.  The only exceptions, of course, are typically when someone is newly hired, quits or is fired or laid off.
