You won't be arrested for failing to respond to the insurance company's letter.
If your insurance company is able to settle the passenger's claim, that will end the matter.
If the passenger's claim is not settled with your insurance company, the passenger will file a lawsuit against you for negligence. Your insurance company will provide you with an attorney at no cost to you to defend you in this matter.
