There are attorneys who are mediators. There are also retired judges who do mediation. In addition, there are professional mediators, who handle cases through Alternative Dispute Resolution. Mediation is an alternative to litigation in resolving a case.
If mediation through the EEOC is not required, the company might want to explore other options to resolve the matter through mediation as mentioned above. It isn't possible to predict whether or not the company will do this.
