Custom and practice in the building trades is that a contractor who does work on a person's home or property can take photographs of work actually done by the contractor for future advertising. Most licensed contractors receive permission (oral or written) from the property owner beforehand.
So long as the photographs depict work actually done by the contractor in your backyard for advertising purposes and are not misleading, your former contractor can do so unless you have a written contract signed by you and the contractor saying that this cannot be done.
Your question does not pertain to the use of a photograph ofyourself for advertisng purposes that was not authorized. That would be a different situation.
