Yes, it may. The law does not prevent any person or entity, including your current employer, from contacting someone to ask "Did you make John/Jane Doe a job offer?" The prospective employer is not required to answer; though if it does not, if the employee does not have an employment contract with his/her current job, and therefore is an employee at will, the current employer could take action against the employee if it thought the failure to answer meant the employee had been lying to it.
