What are my rights if there is mold in my apartment?

I am currently renting a condo. Then about 2 months into the lease, we discovered mold. Again a few months later we are experiencing worse conditions due to the rain and cold weather. The condensation on our windows is extreme and I would assume is not helping the issue. I have contacted both the property management and the owner. All they have done is call out contractors to look at the problem but nothing has been done. I recently put in a request for a mold test to see if it is toxic. I do have a 2 year old that is being exposed which makes me very concerned. What is a proper time span to address this?

If you have water intrusion in your rental, you need to immediately call and write your landlord about the situation requesting an inspection of the unit. You need to have a person experienced also in mold testing to take indoor and outdoor samples to determine the level of spores and the type of mold present.

You might also want to contact your local health department about the situation and have an inspection of your unit as an additional safety precaution. As a precaution, I would have your two (2) year old be checked out by a pediatrician.

You could also contact your local permit and building department about the situation and ask for an inspection of the unit as well. Finally, you might consult with a landlord tenant attorney about the situation you are facing.
