If I haven’t lived with my husband and children for almost 12 months, am I considered

divorced or at least legally separated?

We both want a divorce. We have nothing together anymore except for children and that has been arranged. I personally cannot afford a lawyer and am unemployed. What can I do to get a divorce?

You are not divorced until a court legally ends your marriage. And you are not legally separating until a court issues such an order. If money is an object in filing, you can see if there is a law school nearby to where you live; they typically run low cost clinics that provide legal services. You can also see if you are eligilbe for representation by legal aid. Finally, you can check with the county/state bar association; they may have a list of attorneys who will take your case "pro bono" (i.e. for free).
