I currently own a 2 family home, the other person on the mortgage and title has not paid anything towards the mortgage for 2 years, I reside on the property and am wondering is there a way to take legal action against them to claim funds

As a general matter, you should be able to claim some contribution from the other owner, if there is a negative cash flow;  however, your own "rent" and whatever you are getting from the other unit will also have to be accounted for.
