Asked on 08/31/2012

MY car was stolen while was parked I was paying full coverage. Insurance denying coverage for misrepresenting myself. My Car was stolen while it was parked. I filed claim with insurance and police report right away After i find out that my insurance denied my claim stating that i misrepresented myself. I gave right number of DL right name right address and right social security. I got my insurance thru my broker on the phone. They were informed that my DL at the moment i signed aplication was suspended for Child support reason. Now insurance company claiming that i lied in my aplication in one of the questions on the bottom that says: Has your DL ever been suspended or revocked. Broker marked NO

When information on an auto application is incorrect, it can affect your insurance. You said you got the insurance over the phone. If the broker did not ask if your license had ever been suspended and simply answered no, then they have an errors and omissions issue. However, it will be difficult for you to prove that you did not answer the question as no.You do not indicate if the license is still suspended or not. If it is, it makes your claim less likely to be paid. Most insurance companies will not offer insurance to someone with a suspended license. If it has been reinstated, you should try to work through the broker to see if the insurance company will reconsider the denial of coverage. Since the car was stolen, and your license was valid at the time of the claim, it should not affect the details of the claim.
