Insurance Question from Barry University, FL

Asked on 05/31/2012

my car was recently wrecked and when i called my insurance company they told me that my policy didnt cover my car getting fixed. when i signed the policy i signed up for full coverage so they told me to get my car inspected. I went and got it inspected but the company that inspected it never sent the papers off. So the insurance company mailed me a letter saying that my policy would be cancelled cause they never received my inspection papers. Then i went back to the inspectors and they assured me that they sent the papers off. my insurance company then downgraded my policy to p.i.p from full coverage without my knowledge. Now i have a wrecked car with no money to fix it what should i do?

If an inspection of your vehicle is a requirement to get physical damage coverage on your car, it is your responsibility to obtain the inspection. When you were notified that the insurance company didn’t get the inspection papers, and you followed up with the inspection company, you should have requested a copy of the inspection report as well as followed up with the insurance company to be sure they received the inspection. You did receive a warning from the insurance company that they were cancelling the physical damage coverage on the car. You would have received a reinstatement notice if they were reinstating the coverage for physical damage on the car. Since you did not receive this you should not have assumed that the coverage was put back on the policy. You may have a case against the inspection company if they cannot prove that they sent the inspection form to the insurance company. If they cannot provide this proof you may file a claim against them for their failure to provide the report.
