Insurance Question from Briar Park, NY

Asked on 03/26/2014

If I’m driving the correct way down a one way street and somone comes the wrong way and hits me is it my fault? At my job they recently made a two way street into a one way. There are two no turn signs three do not enter signs and permanent baracade and one way sings. All day long I watch people drive around the baracade in on coming traffic. I'm nervous since I'm coming out if the one way 6-10 times a day that eventually someone's going to hit me and it somehow it'll be my fault. Thanks in advance!

If you are driving the correct direction on a one way street and have an accident with someone going the wrong way, then the accident would most definitely NOT be your fault. The driver going the wrong direction would be responsible for any damages or injuries caused by their inattention, or attempt to save time by going the wrong direction. Their insurance company will handle any such claim should it occur. They would pay for the full cost of repairs to your car, up to its actual cash value as well as any medical expenses you may incur from the accident. It is unlikely that you would be involved in such an accident since you seem to be very aware of the potential problem with wrong way drivers so you are most likely going to be more careful while entering the street and leaving it. However, inattention by the other drivers could still put you at risk of such an accident.
