Insurance Question from Arlington, TN
Asked on 01/18/2012
How should i counter an insurance company’s settlement offer? I, along with my 2 small children, was in a car accident 4 months ago and it was caused by another driver. I have still not received my vehicle back from their preferred auto body shop. I was not severly injured but i did go the er the evening of the accident and had a follow visit a week later. i do have a burn scar on my arm and for about a month had soreness on my arm, wrist, neck, knees, and back. I postponed my school 3 months for recovery and in hopes that this claim would have been resolved. Their initial offer is 2700 for pain & suffering. What should my counter offer be??

You can rest assured that their first offer is their lowest offer. They probably have room to move. It sounds like however, that you have alot to consider in this accident settlement–a scar, lost time from school, pain for a month. Read our article on How to Value Accident Settlements. This may help you determine the value of your claim. Is the scar permanent? Was their gross negligence in causing this accident? You didn’t say how the accident occurred. All of this would also factor into the value of the claim. I would suggest counter offering. However, without knowing the particulars of your accident, I am unable to suggest a counter offer. You also have the option of consulting with a expert personal injury attorney in your area that could better give you a property value of your accident. Consultation are free. It will also let you know that you are getting the proper settlement for your injuries. Click here to consult with a personal injury attorney on your settlement.
