Rescinding homeowner’s insurance for not replacing a roof. I am a customer of American Family and have had their adjusters out for roof inspections three times in the past three years due to wind & hail storms. In each case I was told that there was insufficient damage to warrant replacing the roof. Now with the latest inspection, I was told that there wasn't sufficient damage for the company to replace it, but there is sufficient damage where I have to replace it. If the roof isn't replaced, my policy will be cancelled on the renewal date. Is this legal -- much less ethical?

It is your responsibility to maintain your home properly to avoid damage or loss to the home. Your insurance company has apparently inspected the roof each year, most likely because they have been concerned about the condition of the roof. Even with storms coming through each year, it is possible that the problem is the age of your roof, and not damage caused by the storms.Insurance companies have the right to ask their clients to maintain the home and to repair or replace roofs, steps or other portions of the home to avoid future losses. They will give a reasonable amount of time to make such repairs before they non-renew the insurance, If your insurance is non-renewed you will have an extremely difficult time finding replacement insurance. Not only will you have been non-renewed, but you also have a roof that needs to be replaced, and most other companies will not be willing to write your insurance until the roof is replaced.
