does insurance company have to bring damaged area back to same condition it was in. below is insurance adjusters response. I reviewed the plumber's invoice along with all the photos we have in the file. We have paid for the tile on the bathroom floor. The tile on the walls was not damaged and is not continuous. Your policy only provides coverage for the tile on the floor

In a homeowner insurance claim, the insurance company must replace the damaged or destroyed flooring as far as continuance of the same tile or flooring. An example is if the carpeting is damaged in one room, but it continues throughout the hall, bed room or the like, they must replace it since a partial fix would most likely show a difference.It appears in your case that the adjuster feels the tiling on the wall was not damaged and was not continuous or the same as the floor tiles, so replacement of the wall tiles is not required.If you feel the tiles on the walls were the same and there is a difference in appearance, you should talk to the adjuster or ask to speak to their supervisor to discuss further replacement of tiling in the bathroom. If however, you just want to upgrade the wall tiles, then you would be responsible for these costs. Age of the wall tiles does not warrant replacement of them.
