Consumer Complaint:

My daughter was driving her grandmother’s car & rear-ended & due to illness & then a death in family, my daughter was unable to give her statement. I played telephone tag with ins. co by replying to their letters, informing them of what was going. On 2-14-08 they sent what they refer to as a \”final\” letter advising my mom (the policyholder) that if they did not hear from her within 15 days they would assume that we were not interested in pursuing claim & would close file. I called & left them a message & did not hear from them. On 2-19-08, they left message on ans. machine advising that if they did not hear from us by 2-23, they would close claim. I called them & again did not hear from them. I left several messages but to no avail. Also our ins agent called them & they will not cooperate with her.

See a lawyer. A letter from a lawyer will get action. Unless there is a 1 year statute of limitations - which I doubt -- the other driver's company's administrative decision to close its file has no legal effect.
