I bought a home that was in a pending lawsuit, not disclosed and the title company didn’t find it in public records. It was filed with the circuit court in the Greene County records in Aug of 2007 and I closed on the home in Nov 2007. I am now being sued for purchasing the home. I will be out probably thousands of dollars in the process of this lawsuit. If I had known this I would not have bought this house. I bought an owner policy and thought I was covered.
Insurance Expert Answer:
If the wording of the policy covered the type of matter, your policy should cover it. You attorney knows the facts, knows the policy terms, and can give you FAR more and better advice that we can. Indeed, we'd tell you to get a lawyer as it will take one who knows insurance. HOWEVER, if your lawyer does not know insurance and you're not comfortable with him or her, you have the absolute right to change lawyers and get one who does.
