Consumer Complaint:

I was involved in a rear end collision where I was the one hit by one of their insured. Right after I was hit, my 2001 Chevy Blazer was not operating properly. There were many electrical problems that were diagnosed. After my vehicle was released from the body shop, I had to tow it to a mechanic, where they had an adjuster review it. They told me to go ahead and have the work done, then they would send someone out to review it to make sure it was safe to be on the road before the mechanic releases it. The second adjuster came out when the work was complete and said they were not liable for any of the work. The total bill came out to over $2,600.00. The portion of the bill they were supposed to cover was around $1,500.00. Every time I call them they say that the accident just created \”scratches on the bumper\”, when they actually did about $3,500.00 in body work. I was rear ended when I was at a dead stop at a red light.

Insurance Expert Answer:

If you have collision insurance the best approach is to let your carrier handle it, temporarily absorb the deductible. When your carrier recovers from the other driver's carrier, you'll get a full or partial refund. The alternative is to take the driver and his insurance company to small claims court. His carrier is not your friend, it owes you nothing.
