What should I do next ?
sexual harassment I currently work for
a home health care agency and I’m in a
situation. I’ve had a case now, for
almost a year, where my client
continues to sexually harass me. From
my very first day on the case I
reported to my office about how I was
uncomfortable and their response was
‘deal with it’
A week ago I made yet another complaint
and this time they’re starting to take
action. But they’re telling me I need
to wait for them to find replacement
for me on the case so until then I’m
still stuck in the house with him.
On going harassment, touching,
grabbing, offensive words and actions.
This is not part of my job as a
caregiver, despite him having a brain
injury. If I’m uncomfortable because of
the actions he is doing to me I should
be removed immediately, correct?
I don’t know what kind of steps I need
to take now because my office isn’t
doing what they’re supposed to do.

If you make your employer aware of sexual harassment and they refuse to take action about it, you may have a sexual harassment/discrimination claim: the law prohibits sexual harassment at work, and employers are required to take reasonable steps to prevent or stop it once they become aware. You should speak to the federal EEOC or your state's equal/civil rights agency (in NJ, that is the Division on Civil Rights, or DCR) about the situation; they may be able to help you get compensation under either federal law or under state law (e.g. the NJ Law Against Discrimination).
