Any property that you hold as a joint tenant with rights of survivorship, became our sole property immediately upon your mother's death. This means that it was not part of her estate when she died. And a Will can only transfer assets that are owned by the deceased at the time of their death. As to any other of your mother's property, that would be split evenly with your brother, as per the terms of the Will.
