Since this person is not a tenant (i.e. pay no form of rent) but was invited to stay at the premises, they will be consdiered to be a "guest". In such a case, insead of filing for an eviction you will file for an "ejectment" (basically an eviction of a guest). First you will need to privide proper notice to vacate (this varies from state-to-state but is typically 3-10 days). If they fail to leave within the time specified, then you will need to go to court. At this point, you can concult directly with at an attorney who handles landlord tnenant matters in your area; they can best advise you further.
