Depending on which state your wife was living in when the accident occurred, the statute of limitations may have expired.  Without knowing which state she was living in at the time of the accident, it is not possible to determine whether of not the statute of limitations has expired as it varies from state to state.

If the statute of limitations has expired, that would provide a defense to the lawsuit filed against her and that lawsuit would be barred.

If the statute of limitations has not expired, the auto insurance company that she had at the time of the accident should provide her with an attorney at no cost to her, who will handle the case.
