If my husband had back surgery 4 months ago and a portion of the procedure failed, so he needs to go back into surgery, is it the surgeon’s liability to cover all the cost related to this?

No, the surgeon is not responsible for the cost of the second surgery.  Surgery does not come with a guarantee and the law does not make surgeons give a guarantee.  Back surgery, especially, has mixed results even in the best of surgical hands.
