We know there is a legal case for more damages – but in the mean time we need a
car. Should we deal with insurance to get what we need now? Or wait for court
proceedings? Ideally we can get a car now but still be able to sue for damages

Your property damage claim regarding obtaining a rental car or other car, is separate from your personal injury claim.  You can pursue and settle the property damage claim with the insurance company without affecting your personal injury claim.  The property damage claim is usually settled early in the case.
