In Michigan, medical marijuana patients are often given 1) A medical marijuana card; and 2) A Doctors certified prescription for medical marijuana as a treatment for a specific diagnosis. A person who is on probation, but has a medical marijuana license must first let the judge know that so the Judge can note that in the person probation order. Next that person must convey the same information to their probation officer so they will not be violated for testing positive for marijuana. My advice is to contact a criminal defense attorney in your area and ask them what the remedies are for someone who has a medical marijuana license while they are on probation and ordered not to use or possess marijuana.
