From what you have written it is improper for your former wife to have your minor daughter secretly record matters that are going on in your home albeit whether the conduct amounts to a criminal matter depends upon the laws on the subject in the state where you reside.

However, the possible civil wrong with respect to your privacy being invaded depends upon how the recording occurred and what was depicted lies primarily upon your daughter and secondarily upon your former wife. I suggest that you may wish to consult with a family law attorney further over the matter that you have written about.
