It depends on the business arrangement. If the money was turned over to the cab company, then they pay him a portion of it or wages to drive, they are iiable; but if he keeps all fares (i.e. he basically rents or leases the cab from them, but any money he makes is his), then he is liable. Bear in mind that if neither pays voluntarily, the only way to get the money back would be to sue, and it may not be worth the time and cost (court costs, at least, even if you act as your own attorney) to sue, even in small claims court, for the money.
