You are not married since in the eyes of the law your "husband" was not free to enter into a legal union with you due to his previous marriage still being in effect. This is true even though you had a marriage ceremony. If he is not already divorced, then he needs to get one if you two still wish to get married. If you do not want to marry, then you should file for an anullment, as this will clear up any legal entaglements created by your "marriage".
