What is our recourse if our newly purchased vehicle was repainted by the dealer but that fact was not disclosed to us at the time of purchase?
The repairs were performed by a dealer owned “in house body shop” so they had full knowledge that a panel on the vehicle was repainted due to transportation damage but still do not disclose this to us. It wasn’t until recently that we noticed some over-spray on the vehicle that we contacted the general manager we were told the truth. According to their records, over $500 of body repair was performed on the vehicle because of a minor transportation dent. During the repair some of the vehicle’s original paint had pealed off and thus requiring a respray on one of the panels.

You could possibly seek to rescind the sale due to fraud on the part of the dealer, but I can not imagine that is what you want. It would be difficult to assess what dimunition of value there is to your car due to this minor repair having been made. It seems your only remedy would be recission if that is what your want.
