If I have a trucking company that we set up as a S-corp and there are 5 of us that own it, all having a 20% share, are we required to have work comp on ourselves?

Here is a link to a great starting point for information on Minnesota Worker's Compensation law pertaining to the issue of "Who is required to have workers' compensation insurance (in Minnesota)": http://www.dli.mn.gov/WC/Pdf/fact_sheet_scf.pdf  There is a link to law and rules governing exceptions and a link to information on "independent contractors".  I urge you to seek an attorney to assist you, as the business venture you describe is particularly complex in nature.  I encourage you to make many phone calls to attorneys in choosing, because it is critical that you feel a great sense of trust and confidence in the attorney.
