If I was terminated, can my employer deny paying me PTO that I earned from the previous year?

I had 40 hours paid time off from last year that I was to be paid for. In the middle of January, I was discharged. They are now saying that I do not get my PTO.

In your state, if there is a written employment agreement guarantying you the vacation pay on termination of employment, or at least a written policy of paying employees on termation of employment (such as might be found in an employee handbook), then the employer has to pay you for accrued by unused time. However, in the absence of a written agreement or policy, they do not have to pay you.
