In a personal injury case, you are almost always better off with an attorney.  An attorney can get far more from an insurance company than the 33% contingency fee they take.  That said, a rule of thumb is that total damages should be 2-3X actual medical bills.  So if your medical bills are $5,000, an attorney would expect to get $10,000-$15,000.
