If there is any sexual or intimate contact at all--and this can be a very broad definition, so almost any "romantic" physical contact would fall under this definition--then the 31-year-old has committed a misdemeanor in your state and could be jailed for up to a year. If there is intercourse or any penetration of any kind, it is a felony, and the 31-year-old could go to jail for many years. This would be an exceptionally unwise and dangerous thing for a 31-year-old to do, since he'd be exposing himself to jail time and to a life-long label as a sexual offender.
