Can a felony credit card fraud charge be expunged?

I was not aware of the charge until it was listed on my background check. A warrant was issued 13 years ago and was dismissed 5 years ago. I am pursuing permanent employment with a security company and am confused as to why this dismissed charge is still listed and wondering if it can be expunged from my record.

Many times, in a situation such as this, there is no automatic exungment. You must file for one in order to clear your record. In NM, you can obtain an expungment of an arrest record if the arrest was for a misdemeanor or petty misdemeanor offense and the arrest was not for a crime of moral turpitude, and if records of a final outcome following arrest cannot be located. At this point, you probably should consult directly with a local criminal law attorney.
