I have a small business and after 2 years I have found that
one of my employees had embezzled money from me in the
amount of over 5000. The person has not been employed
with me in 2 years. Is there anything I can do

Unfortunately, it appears that in your state, the statute of limitations, or time within which you must start or initiate a lawsuit, for suing someone who stole from you is only 1 year, so you may be too late to take legal action. Sometimes, courts will give you extra time if you did not and also reasonably could not have discovered the loss until later, so it is possible you are still in time to sue, but the odds are against you--it is the exception when they extend the statute of limitations. If you want to try suing, do so IMMEDIATELY, before more time passes; the longer you wait after discovery of the loss, the less likely the courts are to give you more time.
