If the employer refuses to take action, you can report this to the federl Equal Employment Opportunity Commission or EEOC. Racial discrimination at work is illegal. An employer is not liable when an employee first utters racial slurs, since an employer can't stop it from happening initially...but they have a legal obligation to investigate the matter and, if it appears credible, to take efforts to stop it. If they fail to do so, they are violating their obligations and become liable for the discrimination, too. The EEOC looks into employer discrimination; they can investigate this and take action if warranted.
