Cell Phone Spy Software

I put some spy software on my girlfriends phone because I suspected something and
I was right. However, I did not realize that this is flat out illegal without her
consent. What are the penalties if she decides to prosecutre?

Wiretapping is a serious charge which is, unfortunately, becoming more common.  If your girlfriend decides to prosecute for wire tapping, then you could face a range of punishment options depending on your history.  If you have no prior criminal history, then you may be able to get some type of deferred probation or conditional dismissal.  If you have a longer history, then you could be sentenced to actual jail time.  How much jail time will depend on whether your prosecuted via the state or federal system.  This is not a higher level offense... so, unless you had a horrible history, you would not be subject to a lengthy jail sentence.
