Ok do you have an attorney becuase if you are divorcing and he is already looking to be a jerk you need one.  The car is marital property if purchased during the marriage and paid for with marital funds.  So it is half his and half yours in California.  If there are two cars and there can be proven that that car was intended to be yours for use you have a compelling argument for the court.  Get help.  Good luck.
