an acd has been offered for his paraphenalia possession charge. he must complete 35 hours of community service (15hrs left) first to be allowed to do his summer job in another state and successfully complete his 9 month program. this is conflict with his return to his university in sept.09 he does have a lawyer.

What it sounds like is the student wants a get out of jail free card, and to avoid all negative consequences. Of course drug crimes do have consequences, even if he is lucky enough to get the chance at an Automatic Conditional Discharge ("ACD").
If the youth were sitting in jail that certainly would impact his summer job plans and his return to school in the Fall not to mention the rest of his life.
It seems to me that an ACD is a much better option, even if the student's plans may have to change and the authorities may have limited patience if pressed to accommodate the ACD's terms and conditions to his schedule. Your lawyer will know what to ask for and it becomes a matter of persuasion.
