Advance Directives Videos

An Advance Directive is a written document in which an individual clearly specifies how medical decisions affecting them are to be made if they are unable to make them, or to authorize a specific person to make such decisions for them. This category of videos will tell you about different types of advance directives with different purposes. The documents and the titles of the documents may also differ from state to state, and even from hospital to hospital.

This category includes information about forming an Asset Protection Plan to help minimize the risk of loss from unexpected hazards of businesses and individuals. Asset Protection laws have shields and protect many families from business failures and lawsuits. A plan should be properly designed and managed for best protection.

Estate Planning Videos

General Estate Planning involves the creation of an orderly plan to disperse one’s assets upon death. This category includes information on the writing of a will, the creation of trusts, and consultions with legal and financial experts to determine the best way to minimize taxes and costs of probate. The process of estate planning also consists of taking inventory of your assets and talking over important decisions with family members. Planning your estate will help family members to be aware of how you’d like your financial and medical affairs handled if you become incapable of making your own decisions.

A Living Trust is a legal document that dictates how your business will be conducted upon your death or incapacitation and who is responsible for conducting your business. It usually contains your major assets--home, savings and investment accounts, cars, etc. This category may introduce you to the word, “trustor,” which is the person who sets up the trust, and “trustee,” the person who manages the trust. Generally a trustor assigns himself or herself as trustee, but includes in the trust a list of alternate trustees to succeed him or her, and manage the trust in the event he or she cannot.

The Probate category is all about the legal process called probate through which the court oversees the estate of a deceased person to make sure the debts are paid and the estate is properly distributed to the heirs. Probate is required when the deceased leaves property, real or personal, which cannot be legally transferred any other way. Many people think that probate applies to you only if you have a will. Your estate will be probated whether or not you have made a will.

A Will or Last Will and Testament is a disposition of one’s real and personal property in the form prescribed by law which, though made while living, does not take effect until the death of the maker. In this category, you will likely hear the word “testator” which is commonly used to refer to the maker of a will. Most states require wills to be written documents, and the testator’s execution (signature) to be witnessed by at least two witnesses who are not beneficiaries of the will. A will allows a testator to select a guardian for his or her minor children and to create a trust to hold assets for the benefit of the children, to be administered by a trustee named in the will.
