Would it be worth fighting in court over more of a time loss compensation payment?
Question Details:
I am a truck driver and got into an accident where another semi-truck went head on with my truck while I was parked. It totaled my semi and since I am an owner operator it put me out of a job. I have been fighting with their insurance company for months now over payment for time loss and they have not been willing to give me more than 5 days worth of time loss. But yet it took them 30 days for the insurance adjuster to even go look at my truck as to whether I would be able to fix it or total it out. Would it be worth fighting in court over more time loss payment? Since I was out of work for a good 30 days I would like compensation for my loss since it was not my fault.
Sounds like this insurance company is trying to pull the wool over your eyes. You need to file a consumer complaint regarding unfair and deceptive practices against this insurance company and its individual adjuster and file it with the department of insurance in your state. Furthermore, contact the office of the attorney general and also contact your local union or groups who handle such work issues and see if you can get this insurance company to see the error of its ways. If nothing else helps, sue. Find a good and experienced attorney in the area of insurance litigation (not defense but actual plaintiff's suits) and sue.
