Would it be to my advantage to hire a lawyer in the case of an accident that was not my fault?

Question Details:

I was rear-ended in my 2008 Toyota Prius. My insurance has totaled the car but the other party's insurance will only pay $8,300. I would rather have the car totaled but my insurance is offering $4000 less than I owe (no gap insurance). I did sustain a lower back injury for which I am having physical therapy. It just seems wrong for me to be stuck with a $4000 payoff when the accident was clearly not my fault but I also don't want to pay car payments on a severely damaged car. The frame was bent so badly that the back passenger door will not close. Do I need an attorney?
