Question Details: My step-son was arrested yesterday for Driving Under the Influence of Marijuana, posses ion of 2 grams of Marijuana, posses ion of **** paraphernalia, his court date is October 1. We are scheduled to take him to Milwaukee on Friday to begin in first year of college. Does anything prevent him from being able to leave La Crosse County and attend college as long as he is back for his Oct. 1 court date?
He can leave the county now as long as he is back in time for his court date. After that, if he receives probation, you will need to speak with the court about his leaving the county then.
He really should consult with an attorney as to all of this. This is a highly technical area of the law. An experienced DUI attorney might find some procedural impropriety in our your stepson's arrest and be able to get the charges dismissed or reduced. At the very least he may be able to arrange for some form of alternative sentencing that can leave your stepson able to clear his criminal record.
