Will applying for a home loan modification reaffirm it with the lender?
Question Details:
If we apply, and only apply for a loan modification on a home loan discharged in a bankruptcy, will the application act as an act of reaffirming the loan? Just the act of applying and nothing else? We live in CT and had everything but a student loan discharged.
No. There are strict requirements for reaffirming a debt in the bankruptcy court. The agreement must be on a court approved form, be filed with the court prior to your discharge, and either be signed by your attorney or if not, you must first attend a separate hearing with the Judge in your case to approve the agreement.
