Who would be responsible for injury while attending an estate sale held by an estate settlment company?
Question Details: I attended an estate sale held by an estate settlement company and fell down the stairs. Everyone was required to remove their shoes and the stairs were somewhat narrow and covered in a shag type carpet. The property was in the process of being sold and the closing occurred 2 days after my injury. I believe I badly bruised or cracked my tailbone during the fall. The settlement company will not respond to my emails about the accident. I'm worried they will claim they have no responsibility for injuries at the property. What are my options?
There should be homeowners insurance in effect for the property. Since the house had not closed yet, it likely was still technically owned by the estate of the decedent. I would attempt to make a claim with the homeowners insurance company. Remember, they are only responsible if there was something faulty, hazardous or dangerous about the stairs. If you simply fell, this is not their responsibility.
