Question: Insurance Law - Pennsylvania

Asked on 11/5/2009
Who has to pay for a vehicle totalled in a wreck when owner has now insurance and a friend was driving vehicle?
My son, a licensed PA driver in the marines, borrowed his friend's truck which is registered in NC and had a wreck. Friend thought he had insurance but it was unknowingly cancelled. Friend says my son has to pay off truck. We're in PA and don't know what to do. My son is due to be discharged 12/3/09. We don't have that kind of money.

If your son wrecked your friend's truck, and it's your son's fault, your son has to pay for the damage he caused.  It's really as simple as that.  However, if your son owns a vehicle himself, and has insurance on it that was in force when this wreck happened, he might well be covered for this, since his use of the friend's truck was only incidental.
