I am not admitted in Michigan.  It is difficult to answer this question without really knowing what your assets are.  Generally, though, a Living Trust is a way to avoid Probate and all its complications and paperwork.  All the assets must be transferred in to the trust prior to death.  Go and see an attorney in your area for help.  There are other ways to pass titles to cars and bank accounts upon death rather than even going through a trust.

We cannot determine that based on a simple question because a) we don't serve as your legal counsel and b) we have not reviewed your assets to determine which is better for you.

You should check out the following articles from freeadvice.com and then consult with an estate planning attorney in Michigan.  To find one, try www.attorneypages.com and check out his or her record at the Michigan State Bar.

AttorneyPages has verified that this person is an attorney.

A will costs less and is less complicated, however, it may not accomplish your goals and it may cost your heirs additional time and money in the long run.  Please contact me to discuss in more detail.  John R. Tatone @ 586-868-5100.
