When suit for divorce is filed by one of the parties, how is the other party notified - through the mail or a process server?
Question Details:
I am trying to file dissolution with my wife, but she is being difficult. She advised me that I should have received a certified mailing from the Clerk of Courts Office as she had advised her attorney to file divorce. I thought in Ohio that divorce papers had to be served via a process server (i.e. in person), not certified mail. How are divorce papers served in Ohio, Cuyahoga County?
It isn't always necessary for a process server or sheriff to personally serve the papers; sometimes, certified mail is permitted.
If what you really want is a divorce, don't worry about this, because how service is made has absolutely no bearing on the outcome. The sooner the court is satisfied that service has been made (and you can usually accept service and make it good enough, even if technically it wasn't), the sooner the case can go forward, and the sooner you'll be single again.
